The terms that govern your use of the POLD website and client portal.

Agreement to these terms

These terms govern your use of the POLD website and client portal. By using the website or creating a client account, you agree to these terms. If you enter into a project agreement or proposal with POLD, that agreement governs the specific project; these terms cover everything around it.

Use of the website

You may use this website to learn about our services, review our work, contact us, and manage your projects through the client portal. You agree not to misuse the website — including attempting to access accounts or data that are not yours, disrupting the service, or using it for unlawful purposes.

Client accounts

  • You must provide accurate information when creating an account and keep it up to date.
  • You are responsible for keeping your login credentials confidential and for activity that occurs under your account.
  • We verify your contact details (currently your email address) with one-time codes before granting portal access.
  • Notify us promptly if you believe your account has been accessed without authorization.

Project requests and proposals

Submitting a project request through the portal is an inquiry, not a binding order. We review each request and respond with questions, a proposal, or a decision. A project begins only when both sides agree to a proposal or project agreement.

The proposal or project agreement defines the specifics of each project — scope, deliverables, timeline, pricing, payment schedule, revision rounds, and delivery. Where these terms and a project agreement differ, the project agreement takes precedence for that project.

Client responsibilities

To keep projects on track, clients agree to:

  • Provide the content, materials, feedback, and approvals needed for the project in a timely manner.
  • Ensure they have the rights to any materials they provide (text, images, logos, brand assets).
  • Designate a point of contact who can make decisions about the project.

Payments

Pricing, payment schedules, and payment methods are set out in each project proposal or agreement. Work begins and deliverables are released according to the schedule agreed there. This website does not process payments.

Revisions and delivery

The number of revision rounds, the delivery process, and acceptance criteria are defined in the project proposal or agreement. Requests beyond the agreed scope may be quoted separately.

Intellectual property

Ownership and licensing of project deliverables — including designs, code, and content created for a project — are defined in the project proposal or agreement.

The POLD website itself, including its design, content, and branding, belongs to POLD and may not be copied or reused without permission. Materials you provide to us remain yours.

Third-party services

Projects and the client portal may rely on third-party services — such as hosting, domain registration, databases, email and SMS delivery, or payment providers — that operate under their own terms and pricing. Where a project depends on a third-party service, responsibility for its accounts and fees is set out in the project agreement. We are not responsible for outages or changes in third-party services outside our control.

Included maintenance

Completed website projects include three months of free maintenance, starting from the project's completion date. During this period you can submit maintenance requests through the client portal.

The exact scope of included maintenance — what is covered as maintenance versus what constitutes new work — is governed by your project proposal or agreement. After the included period ends, continued maintenance can be arranged separately.

Cancellation and termination

Either party may end a project engagement as set out in the project agreement, which governs notice, payment for work already performed, and hand-over of materials.

You may close your portal account at any time by contacting us. We may suspend or terminate accounts that violate these terms, misuse the service, or provide false information — and where reasonable, we will notify you first.

Acceptable use

You agree not to use the website or portal to:

  • Break the law or infringe the rights of others.
  • Submit false, misleading, or fraudulent requests or information.
  • Attempt to probe, breach, or circumvent security or authentication measures.
  • Interfere with the operation of the service, including automated scraping or flooding.

Disclaimers and limitation of liability

The website and portal are provided “as is” and “as available.” While we work to keep them accurate, secure, and online, we do not guarantee uninterrupted or error-free operation.

To the maximum extent permitted by applicable law, POLD is not liable for indirect, incidental, or consequential damages arising from use of the website or portal. Liability relating to a specific project is governed by that project's agreement. Nothing in these terms excludes liability that cannot be excluded under applicable law.

Changes to these terms

We may update these terms as our services evolve. The latest version is always available on this page, with the date of the most recent update shown at the top. Continued use of the website or portal after an update means you accept the updated terms; for significant changes, we will take reasonable steps to notify account holders.
